Terms and Conditions
ART. 1 PREMISES
These general conditions of sale apply to all purchases of Masters branded products, trademarks owned by Masters Srl, sold through the e-commerce site masters.it by users classified as "consumers" pursuant to Article 2, or natural persons acting for purposes outside of any entrepreneurial, commercial, artisanal, or professional activity they may carry out.
The site is owned by Masters Srl, an Italian company with registered office in VIA CAPITELVECCHIO 29 CAP 36061, Bassano del Grappa (VI), Italy, VAT number 01852740248 and company registration number REA188777.
Masters Srl is responsible for the sale, payment management, refunds, and invoicing of the Products offered through the Site. Purchases of Products made through the Site will be made between Masters Srl (collectively referred to as the “Parties”), as the seller (the “Seller”), and the consumer who purchases one or more products for purposes, therefore, not related to his or her commercial, entrepreneurial, artisanal, or professional activity.
Masters Srl retains all rights to the site's domain name, as well as all copyright relating to the Site and its contents.
All communications from the Consumer relating to the purchase of the Products – including any reports, complaints, requests regarding the purchase and/or delivery of the Products, the exercise of the right of withdrawal, etc. – must be sent to the Seller (Masters Srl) at the address and using the methods indicated on the Site or via the addresses specified in the articles relating to the individual consumer rights set out in these conditions.
Each purchase is subject to these general conditions of sale in the version that will be published on the Site at the time the order is sent by the consumer.
The site is intended exclusively for consumer use. Under no circumstances may products be purchased on the site by individuals who do not qualify as such. The seller reserves the right to refuse orders that, at its sole discretion, it believes have been placed by individuals who do not qualify as consumers.
If one or more sales are made to a non-qualified Consumer, these general conditions of sale will apply, but in derogation of the same:
- the buyer will not have the right of withdrawal pursuant to Article 10;
- the buyer will not be entitled to any guarantees on the products listed in Article 8 or any other legal guarantee;
- the buyer will not be granted any other guarantees in favor of the consumer provided by law;
- In the exceptional case that the buyer is not a Consumer, the competent court will be that of Rome.
ART. 2 DEFINITIONS
- E-commerce contract
- sales or service contract under which the Seller, or his intermediary, offers goods or services through a website, or other electronic means, and the Buyer (consumer) places the order for such goods or services on that website, or by other electronic means organised by the Seller.
- Sales contract
- any contract under which the Seller transfers, or undertakes to transfer, ownership of goods to the Buyer and the Buyer pays, or undertakes to pay, the price thereof.
- Service contract
- any contract, other than a contract of sale, under which the Seller provides, or undertakes to provide, a service to the Buyer and the Buyer pays, or undertakes to pay, the price thereof.
- Consumer Code
- reference legislation for consumer protection, dictated by Legislative Decree 6 September 2005, n. 206, as last amended (“Consumer Code”).
- Buyer
- natural person acting for purposes other than any entrepreneurial, commercial, craft, or professional activity (Article 3, letter a, Consumer Code).
- Salesperson
- natural or legal person acting in the exercise of their entrepreneurial, commercial, craft or professional activity, or their intermediary (Article 3, letter c, Consumer Code).
- Producer
- manufacturer of the finished good or of one of its components (art. 115, paragraph 2-bis, Consumer Code).
- Contract Compliance
- the goods are compliant if:
- suitable for the habitual use of goods of the same type;
- compliant with the description and qualities presented;
- present the quality and performance expected by the Buyer, taking into account public declarations;
- suitable for the particular use desired by the Buyer and communicated to the Seller.
- Defective good
- a good is defective when it does not offer the safety legitimately expected, taking into account:
- method of placing on the market, presentation, instructions and warnings;
- reasonably intended use;
- time of entry into circulation.
3. SALE OF GOODS PROMOTED ONLINE
- With the Contract, the Seller sells to the Buyer, who purchases, via electronic means, the goods offered on the Site.
- The masters.it website presents the catalogue of goods and/or services promoted online by the Seller.
- The Seller does not guarantee that the image will match the actual item; in the event of any discrepancies, the written information sheet will prevail.
4. ONLINE CATALOGUE UPDATE – GOODS AVAILABILITY
- The Seller ensures that the order will be processed and fulfilled promptly in accordance with Article 5; the catalogue indicates real-time availability and shipping times; the order is confirmed by email ("Order Receipt").
- If an order exceeds availability, the Seller will inform the Buyer and request confirmation within the indicated timeframes.
5. DESCRIPTION OF THE TECHNICAL PHASES NECESSARY TO CONCLUDE THE CONTRACT
- The Contract is concluded online: the Buyer selects the goods, fills the cart, checks data, prices, shipping, payment and clicks "Confirm purchase order with obligation to pay".
- Online publication is an invitation to bid; the order is a contractual proposal subject to these conditions. System receipt does not constitute acceptance.
- The Seller may accept or reject the order; the Contract is concluded with an acceptance email and Shipping Confirmation.
- Charge upon shipment; after payment, the Seller issues a tax document.
- If you do not follow the steps, the Agreement is void.

6. PAYMENT OF THE PRICE, TAXES AND ANY ANCILLARY CHARGES
- The Buyer undertakes to pay according to the times and methods indicated on the Site.
- Prices are expressed in Euros.
- Prices include VAT and taxes; shipping costs and additional charges are not included.
7. METHODS, TIMING AND SECURITY OF PAYMENTS AND POSSIBLE REFUNDS
- Payments are made using methods accepted by the Seller, without additional costs for the Buyer (except for proven costs).
- Refunds are credited within 30 days of receiving the returned goods.
- Payment communications are encrypted and compliant with privacy regulations.
- For missing products, refund to the payment method used.
8. DELIVERY METHODS AND TIMES
- The Seller delivers within 30 days of the conclusion of the Contract, using the methods indicated or chosen by the Buyer.
- If it cannot meet the terms, it will promptly inform the Buyer by email or telephone.
9. METHODS OF STORAGE/ARCHIVING OF CONTRACTUAL DOCUMENTS
Pursuant to Articles 12 of Legislative Decree 70/2003 and 50-51 of the Consumer Code, each order will be archived in digital and/or paper format by the Seller, ensuring confidentiality and security. For copies or requests, please contact info@masters.it.
10. TERMS AND CONDITIONS FOR EXERCISE OF THE RIGHT OF WITHDRAWAL
- The Consumer has the right to withdraw within 30 days of receiving the goods, without penalty.
- Withdrawal can be exercised via email to info@masters.it or via the Reserved Area.
- Returns are accepted within 30 days of the purchase date; costs are borne by the Buyer; original or equivalent packaging is required.
- The Seller will refund within 30 days of receiving the returned goods, using the same payment method unless otherwise indicated by the Buyer.
- Returned products must be unused, intact, and in their original packaging.
- Upon receipt of the notice of withdrawal, all contractual obligations cease.
- No return is possible for hygienic goods or goods that come into contact with intimate parts (underwear, costumes, etc.).
- In case of refund for missing products, refund will be made to the original payment method.
11. GUARANTEE OF CONFORMITY, REPORTING AND ACTIVATION OF PROTECTIONS; OTHER POSSIBLE GUARANTEES
- Conformity guaranteed within 2 years; defects within 6 months are presumed to have existed previously.
- In case of non-conformity, the Buyer may request repair, replacement, price reduction or termination of the Contract.
- The Buyer will lose his rights if he does not report the defect within 2 months of discovering it.
- The complaint must be sent to Masters Srl (registered mail with return receipt) or certified email to masters@cert.assind.vi.it or info@masters.it, with a photo and purchase receipt.
- The refund will be made using the same payment method or by bank transfer, subject to the provision of bank details.
- Replacement conditions: Return unused, original packaging, shipping costs paid; damages in transit handled within 5 business days; refund only for merchandise within 30 days of return.
- All products (excluding underwear and perishables) can be exchanged within 30 days under similar conditions; shipping costs are paid by the customer except for defects or errors. Masters Srl
12. NON-ATTRIBUTABLE FAILURES – UNAUTHORIZED PAYMENTS
- The Seller is not responsible for delays or failure to perform due to force majeure or unforeseeable circumstances.
- The Seller is not liable for fraudulent or illicit use of means of payment attributable to the Buyer.
13. DEFECTIVE PRODUCTS, COMPENSATORY DAMAGES AND RELATED PROOF BURDEN
- The Manufacturer is liable for damages caused by defects; the Seller is liable if he fails to provide the identity of the Manufacturer within 3 months.
- The injured party can request compensation for death, injury or damage to property other than the defective item (over €387.00).
- The request for compensation must be made in writing, clearly indicating the date and place of purchase.
- Compensation is excluded if the injured party, while aware of the defect, voluntarily exposed himself to the risk.
- Whoever put the goods into circulation according to mandatory legal provisions or technical science of the time is not responsible.
14. SPECIFIC HYPOTHESES OF AUTOMATIC TERMINATION OF THE CONTRACT
- The timely payment of essential goods and charges (Art. 6.1 and 6.3) is an essential obligation of the Contract.
- In the event of unjustified non-fulfilment, the Contract shall be automatically terminated pursuant to art. 1456 of the Italian Civil Code.
15. PROCESSING OF THE BUYER'S PERSONAL DATA (REFERENCE TO SPECIFIC INFORMATION)
- The Seller protects personal data in accordance with Regulation 679/2016 and Legislative Decree 101/2018.
- For details, please refer to the Privacy Policy and Cookies Policy on the Site; the data will be processed to record the order, execute the Contract, comply with legal obligations, and manage commercial relationships.
16. SELLER AND BUYER CONTACT DETAILS
- Official communications to the Seller are valid only if sent by registered mail with return receipt to Masters Srl (VIA CAPITELVECCHIO 29, 36061 Bassano del Grappa) or by email to info@masters.it or certified email to masters@cert.assind.vi.it.
- The Buyer indicates his/her residence, contact details and email address for communications during registration.
17. AVAILABLE LANGUAGES AND SUPRANATIONAL USABILITY OF THE SITE
- The Site and services are available in Italian.
- The Terms and Conditions are available in Italian; any translations are for informational purposes only.
- Accessible from any device; orders from third-party countries will be processed as agreed, with delivery to the Seller's premises unless otherwise agreed.
18. ONLINE OUT-OF-COURT DISPUTE RESOLUTION
- Pursuant to EU Regulation 524/2013, the Buyer can refer disputes to ADR/ODR bodies via web procedures.

19. COMPETENT COURT AND LAW APPLICABLE TO THE CONTRACT
- Any dispute is governed by Italian law and submitted to the judges of the consumer forum.
- The mandatory consumer rights are governed by Article 66-bis of the Consumer Code, Article 18 of EU Regulation 1215/2012, Article 6 of EU Regulation 593/2008, and Articles 3 and 57 of Law 218/1995.
The Buyer will be guaranteed the rights provided by mandatory consumer protection laws in the country of residence and/or domicile.
